Terms of Use

(Website and App)

                            

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE GIS WEBSITE OR THE MOBILE APPLICATION

Terms of website and app use

These Terms of Use (together with the Other Applicable Terms) constitute a legal document and govern the terms on which you may use:

  • www.gis.g4s.com (the “GIS Website”) for the purpose of accessing the Global Intelligence System Service as a registered user (the “GIS Services”);
  • G4S TravelAware mobile application software (the “App”) for the purpose of accessing the G4S TravelAware Service through the use of the App (the “G4S TravelAware Services”)

(both GIS Services and G4S TravelAware Services referred to as the “Services”); and

  • the unrestricted parts of the GIS Website as a guest.

Use of the GIS Website and the App includes accessing, browsing, or registering to use the GIS Website or the App.

Please read these Terms of Use carefully before you start to use the GIS Website or the App, as these will apply to your use of each of them. We recommend that you print a copy of this for future reference.

You agree to the Terms of Use by either actually using the GIS Website or App (as the case may be) or clicking a box that indicates that you agree, where such box is made available to you.

If you do not agree to these Terms of Use, you must not use either of the GIS Website or the App.

Other applicable terms

These Terms of Use refer to the following additional terms, which also apply to your use of the GIS Website and the App:

  • Our Privacy Policy https://gis.g4s.com/Pages/CMS/Default.aspx?cmspagename=privacy which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the GIS Website or the App, you consent to such processing and you warrant that all data provided by you is accurate;
  • Our Cookie Policy https://gis.g4s.com/Pages/CMS/Default.aspx?cmspagename=cookie-policy which sets out information about the cookies on the GIS Website and the App; and
  • (App only) As one of the pre-conditions to the use of the App, a User is required to accept the terms of and comply with an End User Licence Agreement which is available when downloading the App,

(together the “Other Applicable Terms”).

Agreement for Service with your Employer: GIS / Mobile Application

Your access to any of the Services is only permitted where there is a written agreement (the “Service Agreement”) between us and a business customer which employs or otherwise engages you (the “Employer”) and where your Employer agrees that you can be a User of that Service (the “User”).

We are not under any obligation to you to provide any of the Services and the Services will only be made available to you to the extent we have agreed to do so with your Employer in the Service Agreement. If, for any reason, G4S ceases to be under an obligation to provide the Service to the Employer then you will no longer be permitted to use the Service and G4S shall also be entitled, without any liability to you, to require you to cease to use the App and/or the GIS Website (or to disable your ability to use them) and to delete the App from your Device.

When accepting these Terms of Use, no other contractual arrangement will arise directly between us and you, other than the Terms of Use and Other Applicable Terms.

Information about us

www.gis.g4s.com is a site operated by G4S Risk Consulting and the G4S TravelAware app is mobile application software licensed for use by G4S Risk Consulting (we or us). We are registered in England and Wales under company number: 04047630 and we have our registered office at Southside, 105 Victoria Street, London SW1E 6QT. Our VAT number is GB 203 3648 38.

Changes to these terms

We have the right to revise and amend these Terms of Use from time to time by amending this page to reflect changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our systems’ capabilities. 

Please check this page regularly to take notice of any changes we made, as they are binding on you.

Changes to the GIS website or the app

We may update the GIS Website and the App from time to time, and may change the content at any time.

Accessing the GIS website and the app

We do not guarantee that the GIS Website or the App, or any content on them, will always be available or uninterrupted or error or virus free or that the content on them or the Service will be accurate, complete or up to date. Access to the GIS Website and the App is permitted on a temporary basis and we reserve the right to temporarily restrict access to some or all parts of the GIS Website and the App in the interests of business efficacy or to protect our network or systems or other users or to limit the number of times or duration access is permitted to the Services. We will use reasonable endeavours to ensure that access to the GIS Website and App is not interrupted by any event within our reasonable control. We will notify you in advance of any planned longer downtime, which, if reasonably practicable, will be scheduled outside of normal United Kingdom office hours. We will not be liable to you if for any reason any of the Services, GIS Website or the App is unavailable at any time or for any period in the afore-mentioned circumstances.

You are responsible for making all arrangements necessary for you to have access to the GIS Website or the App.

You are also responsible for ensuring that all persons who access the GIS Website or the App through your device and/or internet connection are aware of these Terms of Use and Other Applicable Terms, and that they comply with them.

Your account and password

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use or it is in the interests of the security of the GIS Website or the App.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at gisenquiries@rm.g4s.com.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in the GIS Website and the App, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may:

  • Search, view, copy, download and print out material from any page(s) from the GIS Website or the App for your personal use.
  • Copy, revise, customise and use any material from any page(s) from the GIS Website or the App for your personal use.
  • Make available to and you may draw the attention of others to content posted on the GIS Website or the App on a reasonable, non-systematic basis that is not commercially prejudicial to us, subject to crediting us with any material or any third parties where such material is attributed to them.

Our status (and that of any identified contributors) as the authors of content on the GIS Website or the App must always be acknowledged.

You must not use any part of the content on the GIS Website or the App for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of the GIS Website or the App in breach of these Terms of Use, your right to use the GIS Website or the App will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

You may not reproduce, duplicate, copy, modify, reverse compile, disassemble, reverse engineer or re-sell any part of the GIS Website or the App.

Prohibited Uses

You may use the GIS Website or the App only for lawful purposes.  You may not use the GIS Website or the App:

  • in any way or for any purpose that breaches any applicable local, national or international law or regulation;
  • in any way or for any purpose that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • for the purpose of harming or attempting to harm minors in any way; or
  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree not to access without authority, interfere with, damage or disrupt:

  • any part of the GIS Website or the App;
  • any equipment or network on which the GIS Website or the App is stored;
  • any software used in the provision of the GIS Website or the App; or
  • any equipment or network or software owned or used by any third party. 

Texting

You accept that we may send text messages to your mobile phone.

Costs

You or your Employer (as applicable) are responsible for all costs related to your use of any of the Services.

Equipment

As between us and you, you are solely responsible for the technical equipment and any additional services needed to use the GIS Website or the App and access any of the Services, such as a phone with internet connection.

Limitation of our liability

Except to the extent required by law, or as otherwise expressly set out in these Terms, we exclude all warranties, representations, conditions and terms of any kind (whether implied by statute or otherwise) which may apply to the GIS Website, the App, the Services or any of the content on them.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. 

In particular we will not be liable to you for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of the GIS Website or the App or to your downloading of any content on it or them, or on any website linked to it or them.

We assume no responsibility for the content of websites linked on the GIS Website or the App. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

The sole remedy for you, as the User, if dissatisfied with the GIS Website, the App or any of the Services is to stop using them.

To the maximum extent permitted by law, all liability relating to the Services and your use of them is as set out in the applicable Service Agreement(s) with the Employer and we shall be liable only to the Employer in relation to the Services and your use of them and shall have no liability directly to you. Any claim against us in connection with the Services must be made against us by the Employer. 

If, notwithstanding the other provisions of these Terms of Use, we are found to be liable in any way to you for any damage or loss which arises out of or is in any way connected with the Terms of Use (whether in contract, tort or otherwise), our liability shall in no event exceed the lesser of (i) £10,000 and (ii) an amount equal to the sums paid by the Employer to us for the Services in connection with which the claim is being made in the 12 months immediately preceding the date on which the liability first arose divided by the Employer’s number of Users registered for that Service in that same period. You agree if we have any liability to you that arises under or in connection with both these Terms of Use and the End User Licence Agreement that you shall not be entitled to recover twice for the same loss or damage.

Viruses

We do not guarantee that the GIS Website or the App will be secure or free from bugs or viruses but will take reasonable steps to ensure that the GIS Website and the App are virus-free.

You are responsible for configuring your information technology, computer programmes and platform in order to access the GIS Website or the App. You should use your own virus protection software.

You must not misuse the GIS Website or the App by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the GIS Website or the App, the server on which the GIS Website is stored or any server, computer or database connected to the GIS Website or the App. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the GIS Website or the App will cease immediately.

Third party links and resources in the gis website or the app

Where the GIS Website or the App contain links to other sites and resources provided by third parties, these links are provided for your information only.

We have no control over the contents of those sites or resources.

Suspension and termination

We will determine, in our discretion, whether you have a committed a breach of any of the provisions of these Terms of Use, any End User Licence Agreement or the Acceptable Use Policy. When any such breach has occurred, we may take such reasonable action as we deem appropriate. 

This may result in our taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use the GIS Website or the App;
  • issue of a warning to you;
  • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  • further legal action against you;
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to any breaches by you of any of the provisions of these Terms of Use, any End User Licence Agreement or the Acceptable Use Policy.  The responses described above are not limited, and we may take any other action we reasonably deem appropriate.

Applicable law

These Terms of Use, its subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
